At My SUPER Guide LLC (“SUPER”, “our”, “us”, “we”) we know that our users and partners care how personal data is handled. In the following we aim to give an overview of how we collect, use and share personal data and we encourage you to read this Privacy Policy in its entirety.


In this Privacy policy Partner A refers to the user of this app and Partner refers to My SUPER Guide LLC, 8 The Green Suite A, Dover DE 19901, United States of America, File number: 3539122 (individually the "Partner" and Collectively the "Partners").


Consent


By using the app in any manner whatsoever Partner A affirms that he/she accepts the latest effective Privacy Policy, the practices described therein and give his/her authorization for Partner B to collect, use and share Partner A’s personal data in the ways described in the latest effective Privacy Policy.

The latest effective privacy policy will continue to be valid after the termination period has expired.


What does this privacy policy cover?


This Privacy Policy covers how and what personal data Partner B collect, use, store, share and transfer in relation to Partner A’s use of Partner B’s services and app.

Personal data means any personally identifiable data and is not data that cannot be related to a specific Person or Partner. We may anonymize personal data such that it cannot be individually identified.


What personal data is collected?


Partner B may collect, use, store or otherwise process information such as, login data, name, nationality and passport number, residential address, email address, telephone number, invoicing and payment data (such as legal name, legal Address, incorporation Country, VAT / Company / Tax number, payment card and bank account data), transactional data (such as historical purchases of services, goods or similar and data relating to payments made to/from Partner A from/to Partner B), which tour guests Partner A checks in via the app for the departures operated by Partner A and promoted by Partner B, Partner A’s GPS location data collected via the app from when Partner A selects “Ready” in the app before tour departures starts and until Partner A selects finish (button with chequered flag) in the app after tour departures have finished, when and where Partner A starts and ends a departure operated by Partner A and promoted by Partner B, key performance data such as average tip information, relating to tour departures operated by Partner A and promoted by Partner B and reviews relating to tour departures operated by Partner A and promoted by Partner B received on Partner B’s website, app, social media pages or similar, photos shared by Partner A with Partner B, feedback and survey data, interests, and preferences, user content such as historical communication between Partner A and Partner B or other content or data shared by Partner A in connection with Partner A’s use of Partner B’ services and app.


Partner B may collect, use, store or otherwise process technical data relating to Partner A’s use of the app such as IP address, “cookie” data, operating system, browser, location, and time zone as well as data about which pages Partner A visited, in what order and for how long.


We ask for your consent before placing cookies on your devices.


How is the personal data used?


Partner B use personal data as needed to comply with legal requirements.

Partner B also use personal data for it’s or third-party legitimate business interests, such as to execute and enforce the terms and conditons, facilitate the supply of services, goods or similar, process payments or otherwise collect payment for services, goods or similar, administer the relationship with partners, to protect and optimize Partner B’s business or that of group companies, websites, and apps, to provide and optimize services, partner and user experience, marketing content for users and partners, and to suggest relevant services or products to users or partners.


Partner B will use personal data in the areas specifically given in this Privacy Policy and potentially for closely related areas.


By using the app in any manner whatsoever Partner A affirm that he/she gives authorization for Partner B to contact Partner A by email, telephone or through other channels regarding purchases or delivery of services, goods or similar and generally to communicate with Partner A regarding Partner A’s use and experiences of services delivered, the app and related subjects.


Will the personal date be shared?


Partner B does not lease or sell personal data that has not been anonymized such that it cannot be individually identified. Partner B may share personal data that can be individually identifiable with third parties as described below.


Partner B share personal data it reasonably believes is needed to comply with legal requirements and to apply our terms and conditions or other agreements.


Partner B may share personal data with group companies. If this is the case the latest effective Privacy Policy will apply to these companies as well.


Partner B hire the services of other companies, contractors, and individuals to complete tasks on its behalf and may have to share certain personal data with them to allow them to provide services, goods or similar. Unless Partner B explicitly inform Partner A otherwise, these companies, contractors and individuals are not allowed to use personal data that have been shared with them for other things than to complete the intended services for Partner B.


If Partner B chose to sell, merge, or transfer its business or assets or parts thereof, partner, user and customer data is a business asset that may be shared or transferred.


Except for what is described above we will seek explicit consent before sharing personally identifiable personal data with third parties.


Is the personal date transferred internationally?


Partner B is registered in the United States of America and any data provided to Partner B may therefore be stored in the United States of America.

Partner B may have to transfer personal data outside of the EEA to allow third parties to deliver services, goods or similar. We always strive to share as little data as possible.


In the process of using Google Analytics IP addresses will be abbreviated and may be transferred to a server in the United States of America.


Is the personal data secure?


Partner B is committed to keeping personal data secure and take reasonable precaution to do so. Data transmitted over the internet cannot be guaranteed to be entirely secure, consequently Partner A acknowledges that he/she chose to transmit personal data to Partner B over the internet/the app at his/her own risk.

Partner B have implemented suitable systems and procedures to keep personal data secure. Access to personal data is limited to employees and third parties who needs it to exercise their duties or deliver services, goods or similar.


If Partner B discovers a breach of the security of personal data, Partner B will attempt to notify Partner A via the app, or the contact information Partner A has shared with Partner B.


How long is personal data retained?


Partner A can always request that Partner B erase his/her personal data by contacting Partner B via the app please write “Personal Data Request: Erase” in the subject line.

Please note that Partner B may not be able to provide Partner A with services and execute and enforce the terms and conditions if Partner A requests that Partner B erase his/her personal data. Please note that Partner B may keep part of Partner A’s personal data as long as reasonably necessary for Partner B’s legitimate business interests, administrative and legal purposes.


Legal conditions


Under data protection laws Partner A have certain rights regarding personal data.


Access personal data: To access personal data Partner B store about Partner A, please contact Partner B via the app and write “Personal Data Request: Access” in the subject line.


Correction of personal data: If Partner A finds that parts of the personal data Partner B store about Partner A are incorrect, please contact Partner B via the app and write “Personal Data Request: Correction” in the subject line.


Portability of personal data: To request that Partner B transfer personal data to Partner A or a third party please contact Partner B via the app and write “Personal Data Request: Transfer” in the subject line.


Overview of personal data shared for marketing purposes: To request information about which categories of personal data Partner B share with partners, affiliates, third parties or similar for marketing purposes and the contact information for such partners, affiliates, third parties or similar, please contact Partner B via the app and write “Personal Data Request: Third party sharing and contact information” in the subject line.


Erasure personal data: To request that Partner B erase personal data please contact Partner B via the app and write “Personal Data Request: Erase” in the subject line.


Please note that Partner B may for legal and administrative purposes need to retain some data.


OPT-OUT: To opt-out of receiving marketing content from Partner B or third parties follow the instructions that may be included with any marketing content or contact Partner B via the app and write “Personal Data Request: OPT-OUT” in the subject line.


If Partner A opt-out of receiving marketing content, Partner A will not generally withdraw his/her authorization for Partner B to collect, use and share his/her personal data in the ways described in this Privacy Policy.


Restrict or object to processing of personal data: If Partner A wants to restrict or stop processing of his/her personal data, or if Partner A is of the opinion that Partner B is violating Partner A’s rights by processing personal data due to claimed legitimate business interests, please contact Partner B via the app and write “Personal Data Request: Restrict or object to processing” in the subject line.


Withdraw consent: If Partner B is processing personal data on the basis of consent Partner A can withdraw that consent by contacting Partner B via the app and write “Personal Data Request: Withdraw consent” in the subject line. The withdrawal of Partner A’s consent will not apply to data processing that has taken place before Partner A withdrew his/her consent.


Complain: If Partner A thinks Partner B has violated data protection laws, depending on where Partner A reside, it may be Partner A’s right to complain to the relevant national authority where Partner A reside. Partner B will appreciate the chance to alleviate Partner A’s concerns and correct the situation before Partner A do that.



Changes to the privacy policy


As Partner B evolve its business, website, app, services and similar or applicable laws evolve Partner B may need to amend this Privacy Policy without prior notice. Data collected now is subject to the effective Privacy Policy when such data is used. The Privacy Policy in effect will always be posted under “Privacy Policy” in the app. Partner B recommends that Partner A check the information periodically. By visiting or using the app in any manner whatsoever Partner A affirm that he/she accepts the latest Privacy Policy in effect. If Partner A does not agree with changes made in the Privacy Policy Partner A can contact Partner B via the app and write “Personal Data Request: Erase” in the subject line to request that Partner B erase Partner A’s personal data, though please note that Partner B may be unable to deliver services to Partner A if Partner A requests Partner B to delete his/her personal data.


Please note that Partner B may for legal and administrative purposes need to retain some data.
